This Waiver of Liability (the “Waiver”) covers 24 Karat Ranch, a for-profit LLC organized and existing under the laws of the State of Florida’s Equestrian, Agritourism and Palm Beach County Laws, and the waiver includes 24 Karat Ranch and their respective directors, owners, officers, employees, agents, shareholders, affiliates, successors, partners, assigns collectively referred to as “24 Karat Ranch”.
The signee (parents, legal guardians, care takers, others) desire to allow their child (including dependent, ward, other guest under signee care) to engage in all activities (as Participant) related to being at 24 Karat Ranch or any off-site locations where 24 Karat Ranch may host its events. The signee and participants understand the nature of such farm activities and laws of Agritourism and Equestrian Facilities in Florida. In consideration for allowing me or my child (including dependent, ward, guest, other) to participate at 24 Karat Ranch. I hereby freely and voluntarily, without duress, execute this Agreement under the following terms:
- I, the parent or legal guardian (and as “participant” if applicable) , release and forever discharge and hold harmless 24 Karat Ranch and their respective owners, shareholders, directors, officers, employees, partners, agents, affiliates, successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from me or my child’s (dependents or ward’s) visit at 24 Karat Ranch, or any off site locations where 24 Karat Ranch may host its events.
- I understand and acknowledge that this Waiver and Release discharges 24 Karat Ranch, and all owners, staff, vendors, partners and employees from any liability or claim that I, or my child listed on this agreement may have against 24 Karat Ranch and its owners and partner companies with respect to bodily injury, personal injury, illness, death, or property damage that may result from my activities and time spent at 24 Karat Ranch, or any off site locations where 24 Karat Ranch may hosting its events.
- I also understand that 24 Karat Ranch and its owners, staff, vendors, partners and employees do not assume any responsibility for or obligation to provide financial assistance or other assistance to me, including but not limited to medical, health or disability insurance, in the event of injury, illness, death or property damage.
- I, understand that I expressly waive any such claim for compensation or liability on the part of 24 Karat Ranch beyond what may be offered voluntarily and freely by a representative of 24 Karat Ranch in its sole discretion, in the event of such injury or medical expense.
- I hereby release and forever discharge 24 Karat Ranch from any claim whatsoever which arises or may hereafter arise on account of any first-aid treatment or other medical services rendered to me or my child (including dependent, ward, guest, others) in connection with an emergency during their time at 24 Karat Ranch or any off site locations where 24 Karat Ranch may host its events.
- I understand that me and/or my child’s (or my ward’s, dependent’s or others) time with 24 Karat Ranch may include activities that may be hazardous, including, but not limited to, animal interactions and close contact with animals, farm games, activities, digging in the dirt, Arts crafts, goat and all animal interactions, portable restroom use, interaction with other guests and/or staff that maybe infected by Covid 19 or any other sickness. I hereby expressly and specifically assume the risk of injury or harm to me or my child (or ward, dependent, guest, others) in these activities and release 24 Karat Ranch, its owners, staff, employees, and partners.
- If I, or anyone on my behalf makes a claim against 24 Karat Ranch related to me or my child (ward, dependent, or guests under my care) activities and time at 24 Karat Ranch - I agree to indemnify, save and hold harmless 24 Karat Ranch, including its Owners, Staff, Employees, Vendors, Partners and Volunteers from any claim, including without limitation, loss, liability, damage or cost which may occur as a result of any such claim.
- I expressly agree that this Waiver is intended to be as broad and inclusive as permitted by the laws of the State of Florida, and that this Waiver shall be governed by and interpreted in accordance with the laws of the state of Florida. I agree that in the event that any clause or provision of this Waiver shall invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable.
- Under Florida Law and the statues of Florida, Agritourism or an equine activity sponsor or equine professional is not liable for any injury to, or the death of, a participant in related activities resulting from the inherent risks of such activities.
- I have fully read and fully understand the foregoing Agritourism liability release, waiver of right to sue and assumption of all risks. I have consulted and relied upon my own advisors on all questions in connection therewith and fully understand its terms.
- I have read this Release, Waiver of Liability, Assumption of Risk and Indemnity Agreement, and understand that I have given up substantial rights by signing it and have signed it freely and voluntarily.
